精神科の入院形態5種類

精神保健福祉法に基づく入院形態には任意入院・医療保護入院・応急入院・措置入院・緊急措置入院がある。

自傷他害のおそれがある場合は都道府県知事の権限で措置入院か緊急措置入院となる。時間的猶予がある場合は2人以上の精神保健指定医の診察を必要とする措置入院とする。時間的猶予がない場合は1人の精神保健指定医の診察のみで良い緊急措置入院とする。緊急措置入院では72時間を超えて入院させることができない。

自傷他害のおそれがない場合は任意入院か医療保護入院か応急入院となる。患者本人の同意が得られれば任意入院とする。患者本人の同意が得られない場合は精神保健指定医の診察と家族等の同意を必要とする医療保護入院とする。患者本人の同意と家族等の同意が得られない場合は精神保健指定医の診察で応急入院とする。応急入院では72時間を超えて入院させることができない。医療保護入院と応急入院では都道府県知事に届け出る必要がある。

医療保護入院の問題点

人権擁護の機運から措置入院は減少傾向であるが、任意入院も減少傾向で医療保護入院が増加傾向となっている。

単純に人権擁護の観点から考えると本人の同意に基づく任意入院が最も望ましく、任意入院が増加傾向で医療保護入院が減少傾向となるのが望ましい。

実際に「任意入院させるために患者を説得することが重要であり、どうしても患者の同意が得られない場合に家族等の同意を得て医療保護入院させる」とされている。

しかし、任意入院の欠点として

①本人の同意を得るのが家族等に比べて難しい。

②「任意入院の患者は本人の申出があれば退院させなければならない」ように任意入院では患者の権限が大きく精神保健指定医の権限が小さい。

といったことがある。

これに比べて医療保護入院は「精神保健指定医が入院継続を判断できる」といったように、精神保健指定医の権限が大きく精神保健指定医にとっては「使い勝手の良い制度」となってしまっている側面があり増加傾向にあると言われている。

医療保護入院で入院した患者が精神保健指定医の判断に従わずに退院請求・処遇改善請求を出した場合は、退院請求・処遇改善請求の審査が第三者機関である精神医療審査会で行われることになる。
